1.0 Definitions

For the purposes of these Terms and Conditions:

  • “Customer”, “You”, “Your” means any individual accessing this website or purchasing services from SKYDIVE ALBERTA LTD.

  • “Company”, “We”, “Us”, “Our” refers to SKYDIVE ALBERTA LTD., including its directors, employees, contractors, agents, and affiliates.

  • “Website” or “Site” refers to www.skydiveab.com

  • “Booking Time” refers to the scheduled date and time associated with a reservation for services.

2.0 Acceptance of Terms

By accessing this Website or booking services through SKYDIVE ALBERTA LTD., you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions. Continued use of the Website or services constitutes ongoing acceptance of these terms.

3.0 Privacy and Personal Information

SKYDIVE ALBERTA LTD. is committed to safeguarding your personal information in accordance with applicable privacy laws, including Alberta’s Personal Information Protection Act (PIPA).

Personal information collected may include, but is not limited to, your name, contact details, and payment information. The collection, use, and disclosure of such information is governed by our Privacy Policy.

4.0 Eligibility and Participation Requirements

Booking a skydive does not guarantee participation. All participants must meet the following conditions:

  • Age Requirement: Participants must be at least 18 years of age. Minors may only participate with written parental or legal guardian consent and must be accompanied on-site.

  • Identification: Valid government-issued photo identification may be required.

  • Physical Requirements: Participants must be in suitable physical condition. Weight guidelines are generally:

  • Maximum 235 lbs for men

  • Maximum 200 lbs for women

  • Exceptions may be considered based on height and body composition at the discretion of SKYDIVE ALBERTA LTD.

  • Medical Disclosure: You must disclose all relevant medical conditions, injuries, and medications. Failure to do so may result in refusal of service.

  • Medical Restrictions: If advised by a medical professional to avoid high-risk or adventure activities, you must not participate.

  • Substance Policy: No consumption of alcohol or drugs within a minimum of eight (8) hours prior to your skydive. A zero-tolerance policy is strictly enforced.

SKYDIVE ALBERTA LTD. reserves the absolute right to refuse participation to any individual for safety, medical, behavioral, or operational reasons.

5.0 Booking and Payment Processing

A non-refundable deposit of $75 per participant is required to secure a booking. By completing a booking, you consent to providing accurate personal and payment information.

Online transactions are processed through secure third-party payment providers utilizing industry-standard encryption.

6.0 Payment Terms

  • Full payment must be completed prior to participation in any activity.

  • Accepted payment methods include cash, major credit cards, debit, and electronic transfer.

  • Deposits are applied toward the total balance owing.

SKYDIVE ALBERTA LTD. is not responsible for errors, delays, or disputes arising from third-party payment processors.

7.0 Pricing and Promotions

All pricing is listed in Canadian Dollars (CAD) unless otherwise stated and is subject to change without notice.

Applicable taxes and additional fees may apply. Promotional offers are time-limited and may be modified or withdrawn at the Company’s discretion.

8.0 Refunds and Credits

  • Refunds are only issued where cancellation occurs at least 48 hours prior to the Booking Time.

  • Changes to booking date or time are permitted without penalty if made at least 48 hours in advance.

  • Payments and credits may be transferred to another individual and do not expire.

Once a participant has boarded the aircraft, no refunds, credits, or transfers will be issued under any circumstances.

9.0 Cancellations and No-Shows

Failure to provide a minimum of 48 hours’ notice for cancellation or rescheduling will result in forfeiture of any deposit or payment made.

10.0 Service Descriptions

While SKYDIVE ALBERTA LTD. strives for accuracy in all Website content, including service descriptions and pricing, no guarantee is made that such information is complete, current, or error-free.

11.0 Gift Certificates

  • Only gift certificates issued by SKYDIVE ALBERTA LTD. are accepted.

  • Gift certificates are non-refundable, transferable, and do not expire.

  • Certificates may be redeemed at any current or future Company-operated location.

  • Gift Certificates used as deposits will be subject to the standard deposit and refund policies.

12.0 Intellectual Property

All Website content, including but not limited to text, graphics, logos, images, video, and software, is the property of SKYDIVE ALBERTA LTD. or its licensors and is protected under applicable copyright and intellectual property laws.

13.0 Trademarks

All trademarks, logos, and trade dress associated with SKYDIVE ALBERTA LTD. may not be used without prior written consent. Unauthorized use may result in legal action.

14.0 Permitted Use of Website

You are granted a limited, non-transferable license to access and use the Website for personal, non-commercial purposes only.

You agree not to:

  • Reproduce, duplicate, sell, or exploit Website content

  • Use automated tools (bots, scraping, data mining)

  • Misrepresent the Company or its services

Unauthorized use will result in termination of access and may result in legal action.

15.0 Assumption of Risk and Limitation of Liability

Skydiving is an inherently dangerous activity that carries significant risk, including serious injury or death.

By booking or participating, you acknowledge and accept these risks.

To the fullest extent permitted by law:

  • SKYDIVE ALBERTA LTD. disclaims all warranties, express or implied

  • The Company shall not be liable for any direct, indirect, incidental, or consequential damages arising from:

  • Use of the Website

  • Participation in activities

  • Service interruptions or errors

Participation is entirely at your own risk and subject to execution of a separate waiver and release of liability prior to jumping.

16.0 Indemnification

You agree to indemnify and hold harmless SKYDIVE ALBERTA LTD., its officers, employees, and affiliates from any claims, damages, liabilities, or expenses arising from:

  • Your breach of these Terms

  • Your participation in activities

  • Your misuse of the Website or services

17.0 Force Majeure

SKYDIVE ALBERTA LTD. shall not be held liable for any delay or failure to perform due to events beyond its reasonable control, including but not limited to weather conditions, aircraft issues, government restrictions, or other unforeseen circumstances.

18.0 Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein.

19.0 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

20.0 Amendments

SKYDIVE ALBERTA LTD. reserves the right to modify these Terms and Conditions at any time without prior notice. Updated versions will be posted on the Website and take effect immediately upon publication.
